Terms of Use
These terms govern your use of globalexpresship.com and the freight and logistics services provided by Global Express Ship. By using our website or services, you agree to the terms below.
Acceptance of Terms
By requesting a quote, booking a shipment, or otherwise using our services or website, you agree to these Terms of Use. If you do not agree, do not use our services or website.
Description of Services
Global Express Ship arranges and provides freight and logistics services, including air freight, ocean freight, ground trucking, warehousing and fulfillment, and related customs brokerage and supply chain consulting, within the United States and internationally.
Quotes, Rates & Payment
- Quotes are estimates based on the shipment details you provide and are subject to change if actual weight, dimensions, cargo type, or routing differ from what was declared.
- Rates may include fuel surcharges, accessorial fees, and applicable duties or taxes.
- Payment terms are set out in your service agreement or invoice. Late payment may result in interest charges, additional fees, or suspension of services.
Shipper Responsibilities
As the shipper, you are responsible for:
- Providing accurate descriptions, weights, dimensions, and declared values for all cargo
- Properly packaging and labeling shipments for the mode of transport
- Obtaining all licenses, permits, and export/import documentation required for your shipment
- Disclosing hazardous materials in accordance with applicable regulations
Prohibited & Restricted Cargo
Certain goods may not be tendered for shipment without our prior written approval, including illegal goods, undeclared hazardous materials, and items restricted under U.S. or destination-country law. We reserve the right to refuse, hold, or return any shipment that violates this section.
Liability & Claims
Liability for loss, damage, or delay is governed by the liability framework applicable to the mode of transport used for your shipment — for example, the Carmack Amendment for U.S. domestic ground transport, the Montreal Convention for international air carriage, or the Hague-Visby Rules or an ocean carrier's bill of lading terms for ocean carriage — unless a different limit is agreed in writing.
Claims for loss, damage, or delay must be submitted in writing within the timeframe stated in your service agreement or bill of lading. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.
Cargo Insurance
Carrier liability limits are often lower than the full value of your cargo. We recommend purchasing cargo insurance for shipments of significant value. Insurance is available on request and is subject to separate terms and pricing.
Delays & Force Majeure
Transit times are estimates, not guarantees. We are not responsible for delays or failures caused by weather, customs holds, port or terminal congestion, labor disputes, mechanical failure, or other events beyond our reasonable control.
Customs & Regulatory Compliance
International shipments are subject to the customs laws and import/export regulations of the origin and destination countries. You are responsible for ensuring your goods may lawfully be shipped and for providing complete, accurate documentation required for customs clearance.
Website Use & Intellectual Property
The content, design, and trademarks on this website belong to Global Express Ship or its licensors and may not be copied, reproduced, or used without permission. You agree to use this website only for lawful purposes.
Termination
We may suspend or terminate services for non-payment, violation of these terms, or tender of prohibited cargo. You may cancel a booking in accordance with the cancellation terms provided at the time of booking.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from our services will not exceed the amount actually paid for the shipment giving rise to the claim, except where a higher limit applies under mandatory law or a separate written agreement.
Governing Law & Disputes
These terms are governed by the laws of the state in which Global Express Ship is headquartered, without regard to conflict-of-law principles.
Changes to These Terms
We may update these terms from time to time. Continued use of our services or website after changes are posted constitutes acceptance of the revised terms.
